Tracy practices primarily in the area of commercial litigation and dispute resolution. She has been practicing in this area for over 10 years and works across a variety of industries in the public and private sectors.
She is experienced in appeals, ASIC investigations, banking and finance disputes, brand and reputation disputes, competition and consumer disputes, contract disputes, debt recovery and enforcement of securities, electronic trials and electronic discovery, general corporate, commercial and property litigation, insolvency, large complex or representative litigation and lease disputes.
Successfully defended an Australian bank against claims brought by 10 groups of plaintiffs in respect of allegations of misleading and deceptive conduct, unconscionable conduct, negligent misstatement and personal injuries, among other things. The litigation resulted in contemporaneous electronic trails of 14 proceedings in the Supreme Court of NSW and was conducted over 13 months.
Pharmaceutical and Healthcare
Represented a large pharmaceutical and healthcare company in respect of contract disputes, recovery of property by way of injunctive relief, applications to review an Australian Customs and Border Protection decision, defending Federal Court fast track applications in respect of alleged misleading and deceptive conduct and applications for injunctions.
Australian Property Group
Represented an Australian property group in a class action brought against it by applicant purchasers in respect of the proper construction and operation of relevant contracts of sale, including claims for breach of contract and breach of the Australian Consumer Law.
Represented a former CEO of a large leasing company in respect of allegations of financial misconduct and fraud
Acted for a large television network in respect of a dispute with its former solicitor relating to fraudulent conduct, misappropriation of funds, breach of duty of care, breach of fiduciary duty, and misleading and deceptive conduct.
represented various companies in respect of claims by former employees for misleading and deceptive conduct, breach of contract and issues concerning use of intellectual property.
